House Democrats Move to Impeach Homeland Security Secretary Kristi Noem, Citing Civil Liberties and Oversight Disputes

WASHINGTON — A coalition of House Democrats on Thursday announced the introduction of articles of impeachment against Kristi Noem, escalating a months-long confrontation over immigration enforcement, congressional oversight, and the scope of federal authority during domestic unrest. The move, led by Representative Robin Kelly, reflects mounting pressure from progressive lawmakers and civil rights groups, even as the path forward remains uncertain in a divided Congress.

Standing alongside several colleagues at a Capitol press conference, Ms. Kelly said she had secured the backing of nearly 70 House members for three articles of impeachment. The charges allege obstruction of Congress, violation of public trust, and self-dealing — claims the Department of Homeland Security has rejected.

“This is not a movie,” Ms. Kelly said. “This is real life, and real people are being hurt.”

The Allegations

The first article accuses Secretary Noem of obstructing congressional oversight by denying members access to Immigration and Customs Enforcement detention facilities. Ms. Kelly said she and others were barred from an ICE site in suburban Chicago despite, in their view, complying with notice requirements.

DHS officials have said that access policies are designed to ensure safety and operational integrity and dispute the characterization that oversight has been unlawfully blocked.

The second article centers on alleged violations of public trust, including claims that DHS agents carried out warrantless arrests and used excessive force during operations in cities such as Chicago, Minneapolis, and Portland. Lawmakers cited videos circulating on social media that show tense encounters between federal agents and civilians. DHS has said its operations are targeted and lawful, and that agents act under established authorities.

A third article alleges self-dealing, asserting that the department steered contracts to politically connected firms and spent roughly $200 million on recruitment advertising. DHS has said its contracting processes comply with federal law and that recruitment efforts are necessary to address staffing shortages.

Representative Adriano Espaillat, chair of the Congressional Hispanic Caucus, joined Ms. Kelly, describing conditions in detention facilities as “inhumane” and alleging deaths in custody. DHS has acknowledged deaths in custody nationally while emphasizing that each case is reviewed and that detainees receive medical care consistent with federal standards.

Representative Maxine Dexter, a physician, said recent incidents in her district demanded accountability. “These are not isolated events,” she said, calling for Congress to act. Her remarks echoed concerns raised by advocacy organizations that have pressed for independent investigations.

Representative Nydia Velázquez framed the issue more broadly, arguing that DHS has been used to pressure cities with differing political views. Administration officials deny targeting jurisdictions for political reasons, saying enforcement decisions are driven by public safety priorities.

Secretary Noem and DHS have forcefully rejected the impeachment push. In statements and media appearances, the secretary has said the effort is “political theater” and that the department enforces the law uniformly. She has also argued that lawmakers unhappy with existing statutes should pursue legislative changes rather than impede enforcement.

In a recent interview on CNN, Ms. Noem said DHS would continue its operations and cooperate with oversight “consistent with the law.” The department has not indicated it will alter deployment plans in Minneapolis or elsewhere.

Impeachment is a constitutional process that begins in the House; adoption of articles requires a simple majority. The Senate then conducts a trial, where conviction requires a two-thirds vote. At present, Democrats do not control a two-thirds majority in the Senate, making removal unlikely even if articles were adopted.

House leadership has not committed to bringing the articles to the floor. Speaker Mike Johnson has previously signaled skepticism about impeachment efforts aimed at Cabinet officials absent bipartisan support.

“This is about oversight,” Ms. Kelly said, closing the press conference. “The Constitution gives Congress a duty to act.”
