WASHINGTON — A federal judge on Thursday issued a sharply worded opinion blocking Defense Secretary Pete Hegseth from enforcing a formal censure against Senator Mark Kelly, ruling that the reprimand likely violated the First Amendment rights of the retired Navy captain.

In a 29-page opinion, U.S. District Judge Richard Leon granted a preliminary injunction ordering the Defense Department to withdraw a letter of censure placed in Mr. Kelly’s military file. The reprimand stemmed from a public video in which Mr. Kelly reminded service members that they are not required to obey unlawful orders — a principle long embedded in military law.

Judge Leon concluded that Mr. Kelly’s remarks constituted protected speech on a matter of public concern and that the government had failed to justify punitive action. “Rather than trying to shrink the First Amendment liberties of retired service members,” the judge wrote in his closing passage, “the Secretary and his fellow defendants might reflect and be grateful for the wisdom and expertise that retired service members have brought to public debate for over 250 years.”

The dispute arose after Mr. Kelly, who served more than two decades in the Navy before entering politics, released a brief public service-style video addressing lawful orders and constitutional obligations. Defense officials criticized the video as inappropriate and, according to court filings, considered potential disciplinary measures. A grand jury in Washington reportedly declined to pursue criminal charges related to the matter.

Unable to secure criminal proceedings, the Defense Department issued a formal censure, placing the reprimand in Mr. Kelly’s military record. Though retired officers retain limited connections to the armed forces, including pension benefits and certain honorary privileges, legal experts note that the scope of the Pentagon’s authority over retired personnel is narrower than over active-duty members.

Mr. Kelly filed suit in federal court, arguing that the censure was retaliatory and intended to chill constitutionally protected speech. Judge Leon agreed that the senator had demonstrated a likelihood of success on the merits of his First Amendment claim and that the reprimand could cause reputational and professional harm.

The opinion also addressed a threshold procedural question: whether Mr. Kelly was required to exhaust internal military administrative remedies before seeking judicial relief. The Defense Department contended that he should have pursued those channels first. Judge Leon rejected that argument, finding that such efforts would likely have been futile under the circumstances.

While acknowledging that active-duty service members may face certain speech restrictions not applicable to civilians, the judge emphasized that those limitations do not automatically extend to retirees speaking in a personal capacity about public issues. The ruling draws a distinction between preserving military discipline and punishing political expression.

The Defense Department has not announced whether it will appeal the preliminary injunction to the U.S. Court of Appeals for the District of Columbia Circuit. Legal analysts say an appeal could focus on procedural grounds rather than contesting the First Amendment analysis directly.

The opinion’s tone stood out. Judge Leon opened with a reference to Bob Dylan’s lyric, “You don’t need a weatherman to know which way the wind blows,” signaling skepticism about the department’s motivations. Throughout the decision, he described the government’s position in pointed terms, suggesting that the reprimand was driven by political disagreement rather than legitimate military necessity.

For now, the injunction requires the Pentagon to remove the censure while the case proceeds. The ruling adds to a growing body of judicial decisions scrutinizing executive branch actions on constitutional grounds.

Whether higher courts uphold Judge Leon’s reasoning remains uncertain. But the decision underscores a broader principle: even in matters touching the military, federal courts remain prepared to enforce constitutional protections when they believe those rights have been infringed.
