The ‘Secret Safe’ and the Missing Polaroids: How Ted Lieu Exposed the FBI’s Failure to Subpoena the Epstein Estate

WASHINGTON — In a methodical and chilling exchange that has refocused national attention on the 2019 raid of Jeffrey Epstein’s Manhattan mansion, Representative Ted Lieu (D-CA) used a combination of investigative journalism and witness testimony to challenge FBI Director Kash Patel over “missing” photographic evidence and the Bureau’s apparent refusal to subpoena the Epstein estate.

The confrontation, which unfolded during a House oversight hearing, centered on the contents of a safe discovered during the federal search of Epstein’s residence—a safe that author Michael Wolff claims contained “Polaroids spread out like playing cards” depicting a prominent public figure in compromising situations with minors.

The ‘Safe’ and the Michael Wolff Testimony

Representative Lieu began his line of questioning by establishing documented facts: the FBI searched Epstein’s residence in 2019 and discovered a safe. While Director Patel initially claimed he did not have the “catalog of evidence” in front of him, he ultimately accepted Lieu’s representation of the search.

Lieu then played a video clip of Michael Wolff describing a private meeting with Epstein. According to Wolff, Epstein personally opened his safe to reveal photographs of the current President of the United States at Epstein’s Palm Beach residence. When Lieu asked if the FBI possessed any such photos, Patel’s response was a flat “No.”

“How do you know that?” Lieu pressed. Patel’s defense relied on institutional weight, arguing that such information would have been “brought to light by multiple administrations” over the last 20 years.

The ‘Birthday Note’ Precedent

Lieu immediately dismantled Patel’s logic by introducing the “wonderful secret” birthday note—a handwritten message from the President to Epstein written over an inappropriate drawing. Lieu pointed out that this highly damaging document was not discovered or surfaced by the FBI, but was instead forwarded to Congress by the Epstein estate.

“If something as specific and damaging as a handwritten note could remain unknown for years… then your confidence that the photographs would already have emerged is not as solid as you frame it,” Lieu argued. Patel acknowledged the point, admitting, “You raise a great point.”

The most heated segment of the hearing involved the FBI’s legal authority to compel the Epstein estate to release its “voluminous” holdings. Patel claimed that the estate had “no obligation” to provide material even pursuant to a subpoena.

Lieu’s reaction was immediate and sharp. “That’s just false. You’re the freaking FBI,” Lieu stated, arguing that the Bureau has the clear authority to subpoena the estate for any remaining evidence. Patel doubled down, insisting, “That’s literally not how it works,” creating a fundamental disagreement over law enforcement’s power to pursue the estate’s private property.

The hearing concluded with the revelation of significant investigative gaps:

  • The Wolff Recordings: Patel admitted he did not know if the FBI had requested or subpoenaed approximately 100 hours of recorded interviews Wolff conducted with Epstein.

  • Estate Holdings: Patel confirmed the FBI does not possess the full body of material held by the Epstein estate, meaning a secondary archive of evidence exists outside of federal control.

  • Personal Review: Patel admitted he has not personally reviewed all the photographs or documents in the Epstein files, relying instead on what investigators “brought to his attention.”

Institutional Fallout

The hearing ended with a commitment from Patel to “follow up” on whether the FBI would interview Michael Wolff or seek his recordings. However, the damage to the Bureau’s narrative of a “complete” investigation was already done. By proving that the FBI failed to locate the birthday note that the estate later produced, Lieu effectively argued that the “secret safe” and its alleged contents remain a valid, unpursued lead.
