Charlotte Hale, a lawyer from LegalVision, explained that Australia does not currently have a broad standalone “image right” law that gives politicians or celebrities complete ownership over every use of their likeness.

That means using a public figure’s face in satire or political commentary is not automatically illegal.

However, the situation changes significantly when the content begins creating the impression that the person officially endorsed, visited, sponsored, or collaborated with the business involved.

And this is where many business owners may have unintentionally stepped into a grey zone.

Several of the viral posts looked highly realistic. Some included captions implying Albanese was directly connected to the company. Others presented the AI-generated images without any disclaimer at all.

To many viewers scrolling quickly through social media, the posts could appear genuine at first glance.

That matters legally.

Under Australian consumer law, businesses can face serious problems if advertising or promotional content creates a misleading overall impression — even when there was no deliberate intention to mislead the public.

This principle becomes especially important in the age of artificial intelligence, where fake images are becoming increasingly difficult to distinguish from real photographs.

Legal experts warn that disclaimers may help reduce risk, but they are not always enough.

If the overall presentation still convinces viewers that an event actually occurred, courts may still consider the material misleading.

In other words, simply writing “this is parody” somewhere in small text may not fully protect a business if the image itself appears realistic enough to fool people.

The debate has also reopened wider concerns about how quickly AI technology is transforming political communication online.

Only a few years ago, creating convincing fake political images required advanced editing skills and expensive software. Today, anyone with a smartphone can generate highly realistic AI pictures within seconds.

That speed has changed everything.

Political satire, once limited to cartoons or obvious photo edits, now blends almost seamlessly with reality. The line between humor, misinformation, marketing, and manipulation is becoming harder for ordinary users to recognize.

And governments around the world are struggling to keep up.

Australia is not the only country facing these questions. Across Europe and the United States, lawmakers are debating how AI-generated political content should be regulated — especially when it influences elections, public trust, or commercial advertising.
